AI Transparency
AI transparency at KiAvatars
Mandatory disclosure under Art. 50 EU AI Act
We use artificial intelligence to create videos, avatars, images and voices. This page openly shows which systems we use, how we work with them and what rights you have.
This English version is a translation provided for convenience. In case of doubt, the German version is legally binding.
01
Which AI systems we use
KiAvatars uses several specialised AI tools for different production steps. We do not develop our own AI models; we exclusively use established providers.
- Avatar video
- HeyGen (HeyGen Inc., USA — Standard Contractual Clauses under Art. 46 GDPR)
- Voice
- ElevenLabs (ElevenLabs Inc., EU data residency enabled)
- Image generation
- Nano Banana, Flux, GPT Image, Gemini 3 Pro — via fal.ai (USA — SCC)
- Video generation
- Seedance, Kling, Veo — via fal.ai (USA — SCC)
- Further image tools
- Higgsfield, OpenArt, Freepik AI, Midjourney (EU / USA)
- Text & concept
- Claude (Anthropic PBC, USA — SCC)
SCC = Standard Contractual Clauses (Art. 46 GDPR). EU residency = data is processed exclusively in EU data centres.

How we use AI — our principles
Humans have the final say. Every final result is editorially reviewed before delivery by Holger Kersten personally.
Everything is labelled. Every delivered video carries a visible and machine-readable AI label in accordance with Art. 50 EU AI Act.
No training on your data. For all tools we use, the use of your content for AI training is disabled.
Voices only with consent. Voice cloning is carried out exclusively on the basis of explicit written consent from the person concerned.
Full tool list on request. On request, you will learn which tools were used for your specific project.
EU law first. We follow the EU AI Act and GDPR as a minimum standard — even when a project is distributed outside the EU.
03
How to recognise AI content
All AI videos and AI images we produce are marked as AI-generated on three levels:
- Visible: a notice in the video (e.g. “AI” as an overlay) and in the description or caption.
- Machine-readable: metadata (C2PA, EXIF) is embedded — automatic detection by platforms is possible.
- In the contract: we state in writing which AI systems were involved in your production.
For deepfakes — i.e. the digital reconstruction or manipulation of a real person — an extended labelling obligation applies. We only implement deepfakes with the explicit consent of the person depicted.
04
Your rights
- Information: you have the right to know which tools and models created your video.
- AI-free alternative: when commissioning, you can choose a classic, AI-free production.
- Data deletion: you have the right to deletion of your personal data at any time (Art. 17 GDPR).
- Withdrawal: consents granted — e.g. for voice cloning — can be withdrawn at any time with effect for the future.
- Complaint: if you have data protection concerns, you can contact the competent data protection authority.
05
Legal basis
This transparency page fulfils the obligations under:
- Art. 50 EU AI Act (Regulation (EU) 2024/1689) — transparency obligations for providers and deployers of certain AI systems; applicable from 02.08.2026.
- Art. 4 EU AI Act — obligation to ensure sufficient AI literacy of everyone involved; already applicable since 02.02.2025.
- GDPR (Regulation (EU) 2016/679) — in particular Art. 9 (special categories of personal data) for voice processing.
- Sections 22, 23 KUG (German Art Copyright Act) and the general right of personality regarding avatar and voice use of identifiable persons.
